PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING CRAFTOS OR CRAFTBOT.
BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS.
IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.

1. Acceptance of Terms

These Terms of Service ("Terms") are a legally binding agreement between you ("User," "you") and CraftOS ("we," "us," "our") governing your access to and use of the CraftOS platform accessible at craftos.net, CraftBot (our open-source personal AI assistant), and any APIs, developer tools, integrations, or related services provided by CraftOS.

By creating an account, downloading CraftBot, or otherwise using our services, you represent that you are at least 18 years of age or have legal authority to enter this agreement, that you have the authority to bind yourself or your organization to these Terms, and that you have read and understood these Terms in full. If you do not agree to these Terms, you must not access or use our services.

2. Definitions

Throughout these Terms, the following definitions apply. "Services" refers to all CraftOS products, platforms, APIs, CraftBot software, websites, and associated features. "Platform" refers to the cloud-based CraftOS service accessible at craftos.net. "CraftBot" refers to the open-source, self-hosted AI assistant distributed under the MIT License at github.com/zfoong/CraftBot.

"User Data" means any data, content, or information you input into, upload to, or process through the Services. "AI Agents" refers to automated software processes operated by CraftOS that execute tasks on your behalf. "Outputs" means content, results, or actions generated by AI Agents in response to your instructions. "LLM Provider" refers to third-party large language model services used by the Services. "Third-Party Services" refers to external platforms integrated with CraftOS via OAuth or API.

3. Account Registration & Access

3.1 Account Creation

To use the CraftOS Platform, you must create an account by providing accurate, current, and complete information as prompted by our registration process. You agree to update your account information promptly to keep it accurate and complete at all times. Providing false, misleading, or outdated information constitutes a breach of these Terms and may result in immediate termination of your account. You are solely responsible for all activities that occur under your account, whether or not you have authorized such activities, and you agree to monitor your account for any unauthorized use.

3.2 Account Security

You are responsible for maintaining the confidentiality and security of your login credentials, API keys, and any other authentication mechanisms associated with your account. You must implement reasonable security measures to prevent unauthorized access, including using strong passwords, enabling two-factor authentication where available, and keeping your credentials secure. You must notify us immediately at info@craftos.net if you become aware of or suspect any unauthorized access to your account, any security breach, or any unauthorized use of your credentials. CraftOS shall not be liable for any loss, damage, or other consequences arising from your failure to maintain the security of your account or from any unauthorized access that results from your negligence. We reserve the right to suspend or terminate your account if we reasonably believe that your account security has been compromised.

4. License Grant & Permitted Use

4.1 CraftOS Platform

Subject to these Terms and payment of applicable fees, CraftOS grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Platform during your active subscription period, solely for your own internal business purposes.

4.2 CraftBot

CraftBot is released under the MIT License. You may freely use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the CraftBot software, provided that the original copyright and license notices are included in all copies. Commercial use and monetization of CraftBot are permitted provided you credit the CraftOS project in any distribution.

4.3 Restrictions

Regardless of the above licenses, you may not use the Services for any unlawful purpose or in violation of applicable law, reverse engineer or decompile proprietary closed-source portions of the Platform, or use the Services to build a directly competing product without prior written consent from CraftOS. You may not use automated means to scrape or crawl the Platform beyond normal API use, transmit spam, malware, phishing materials, or any harmful code, or circumvent or bypass any security, authentication, or access control mechanisms. Additionally, you may not use the Services in a manner that damages or impairs the Platform or interferes with other users, or misrepresent your identity or impersonate any person or organization.

5. User Data, Content & AI Outputs

5.1 Ownership of Your Data

You retain all ownership rights in and to your User Data. By using the Services, you grant CraftOS a limited, non-exclusive, worldwide, royalty-free license to process your User Data solely to provide and operate the Services on your behalf.

5.2 Your Responsibility for User Data

You are solely responsible for ensuring your User Data:

5.3 AI Outputs — Important Disclaimer

AI Agents and LLMs produce outputs based on your instructions and may generate inaccurate, incomplete, or unexpected results. CraftOS does NOT warrant the accuracy, reliability, or fitness of any AI Output for any specific purpose. You are solely responsible for reviewing, validating, and taking responsibility for any action taken based on AI Outputs — especially in financial, legal, medical, or safety-critical contexts.

5.4 No Training on Your Data

CraftOS does not use your User Data, task instructions, prompts, or agent outputs to train our own proprietary AI models without your explicit opt-in consent. Your data remains yours, and we respect the boundary between providing you with a service and using your data for our own purposes.

5.5 Third-Party LLM Processing

When using CraftOS cloud features, your prompts and task instructions are transmitted to your configured LLM Provider. Each LLM Provider's own terms and data handling policies apply independently to data submitted to them. CraftOS has no control over how LLM Providers process or store that data.

5.6 Self-Hosted CraftBot

For self-hosted CraftBot deployments, all User Data, memory, and agent activity remain on your own infrastructure. You are responsible for securing, backing up, and managing that data. CraftOS has no access to locally stored data unless you explicitly enable cloud sync features.

6. Third-Party Integrations & OAuth

The Services support integrations with various third-party platforms to extend the capabilities of our AI agents. By enabling these integrations, you authorize CraftOS to access the specific data and functionality you grant via OAuth or API, and you confirm that you have the right and authority to grant such access. You acknowledge that your use of integrated services is also governed by those services' own terms and privacy policies, and you understand that you can revoke any integration at any time from your account settings or the third-party service's permissions page.

CraftOS is not responsible for the availability, accuracy, or security of third-party services. Changes to a third-party API may affect integrated features, and we will make reasonable efforts to notify you of any significant disruptions.

7. Subscriptions, Pricing & Payment

7.1 Subscription Plans

Access to the CraftOS Platform is available through subscription plans described at craftos.net/pricing.html. Pricing and features are subject to change with reasonable notice.

7.2 Billing

Subscription fees are billed in advance on a monthly or annual basis. By providing payment information, you authorize CraftOS to charge your selected plan. All fees are non-refundable except as stated herein or as required by applicable law.

7.3 Free Plans & Trials

CraftOS may offer free tiers or trial periods. At the end of any trial, the Services may revert to a free tier with limited features unless you subscribe to a paid plan.

7.4 Price Changes

We will provide at least 30 days' notice before any price changes take effect for existing subscribers. Continued use after that date constitutes acceptance of the new pricing.

7.5 Taxes

All fees are exclusive of applicable taxes. You are responsible for paying all taxes applicable in your jurisdiction.

7.6 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. CraftOS does not provide pro-rated refunds for partial billing periods unless required by consumer protection law in your jurisdiction.

8. Acceptable Use Policy

You agree not to use the Services to process, generate, or facilitate content or activities that are illegal, harmful, fraudulent, deceptive, or abusive. This includes content that violates the privacy or personal data rights of third parties, constitutes harassment, hate speech, or threats toward any individual or group, or infringes intellectual property rights of third parties.

You may not use the Services to generate or distribute malware, ransomware, phishing materials, or cyberattack tools, or to engage in non-consensual surveillance, stalking, or tracking of individuals. The creation of deepfakes or misleading synthetic media designed to deceive is prohibited, as is any activity involving financial fraud, market manipulation, money laundering, or the exploitation or harm of minors in any way. You may not attempt to access systems or data you are not authorized to access.

CraftOS reserves the right to suspend or terminate access for any user found to be in violation of this policy, without prior notice.

9. Intellectual Property

9.1 CraftOS Proprietary Rights

The CraftOS name, logo, website design, and proprietary components of the cloud Platform are owned by CraftOS and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or trade names without prior written consent.

9.2 Open-Source Components

CraftBot is made available under the MIT License. Your use of CraftBot's open-source code is governed by the terms of that license. Contributions to the repository are subject to the CONTRIBUTING.md guidelines.

9.3 Feedback

If you provide CraftOS with feedback or suggestions, you grant CraftOS a worldwide, perpetual, irrevocable, royalty-free license to use such feedback for any purpose, including incorporating it into future versions of the Services, without any obligation to compensate you.

10. Disclaimers & Warranties

Specifically, CraftOS does not warrant that the Services will be error-free, uninterrupted, or always available, that AI Outputs will be accurate, complete, or suitable for your specific purpose, that the Services will meet your specific business requirements, or that any defects or errors will be corrected on any particular timeline. You use the Services at your own risk and discretion.

11. Limitation of Liability

Our total cumulative liability to you for any claims arising from these Terms or use of the Services shall not exceed the greater of the fees you paid to CraftOS in the 12 months preceding the claim, or JPY 10,000. Some jurisdictions do not allow the exclusion or limitation of certain liabilities; in such jurisdictions, our liability is limited to the minimum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless CraftOS, its founders, officers, contractors, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, your User Data, your violation of these Terms, your violation of any applicable law or the rights of a third party, and your use or misuse of AI Outputs.

13. Term & Termination

13.1 Term

These Terms remain in effect from the date you first access the Services until terminated by either party.

13.2 Termination by You

You may terminate your account at any time by deleting your account in Settings or by contacting info@craftos.net. Termination does not entitle you to a refund for pre-paid fees.

13.3 Termination by CraftOS

CraftOS may suspend or terminate your access immediately and without notice if you breach these Terms, engage in activities that threaten the security or integrity of the Services, or if required by applicable law. For non-urgent violations, we will provide reasonable notice where practicable.

13.4 Effect of Termination

Upon termination, your license to use the Services ends immediately, we will retain or delete your data per our Privacy Policy, and provisions that by nature should survive (intellectual property, limitation of liability, indemnification, dispute resolution) will continue to apply.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Japan, and both parties agree to submit to the personal jurisdiction of such courts.

We encourage you to contact us first at info@craftos.net to resolve any dispute informally before initiating formal proceedings. We will make good-faith efforts to resolve disputes within 30 days. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. General Provisions

These Terms, together with our Privacy Policy and any Order Form, constitute the entire agreement between you and CraftOS regarding the Services. If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect. Failure to enforce any provision shall not constitute a waiver of future enforcement rights.

You may not assign your rights or obligations under these Terms without our prior written consent, while CraftOS may assign these Terms in connection with a merger, acquisition, or sale of assets. CraftOS is not liable for delays or failures resulting from circumstances beyond our reasonable control, including natural disasters, cyberattacks, or third-party service outages.

All legal notices to CraftOS should be sent to info@craftos.net, and we will provide notices to you via the email address associated with your account. These Terms are written in English, and in the event of any conflict with a translated version, the English version shall govern. We may update these Terms at any time, and material changes will be communicated via email and a notice on our website at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
